For applications for all apartment communities managed by Abbitt Management LLC I/We hereby apply to lease the above described premises for the term and upon the conditions above set forth and agree that the rent is payable on the first day of each month in advance. As an inducement to the owner of the property and to the agent to accept this application, I/We do hereby authorize the Landlord to perform a credit report investigation and any criminal background checks the Landlord deems necessary and appropriate to determine eligibility for the dwelling unit in accordance with the Landlord’s Tenant Selection Criteria. I/We do hereby certify that I/We are over the age of eighteen years and that the information contained in this Rental Application is true and accurate to the best of my/our knowledge and belief. I/We agree all application fees are nonrefundable. This Rental Application upon approval will become part of the Rental Agreement. As of the date of approval of this Rental Application and receipt of application deposit, the Landlord is removing the dwelling unit applied for from being “available for rent”. The Rental Agreement will be executed upon approval of this Rental Application. Therefore, if you do not sign the Rental Agreement and take possession of the dwelling unit upon the date specified in this Rental Application, the Landlord will make deductions from your Application Deposit. (In VA in accordance with the provisions of the Virginia Residential Landlord Tenant Act). Please make arrangements for all Tenants to sign the Rental Agreement prior to taking possession of the dwelling unit. For properties located in Virginia, applicant(s) should exercise whatever due diligence they deem necessary with respect to information on any sexual offenders registered under Chapter 23 (Section 19.2-387, et.seq.) of Title 19.2. Such information may be obtained by contacting your local police department or the Department of State Police, Central Criminal Records Exchange, at 804-674-2000, or by looking on the State Police website at www.state.va.us/vsp/. For properties located in North Carolina, applicant(s) should exercise whatever due diligence they deem necessary with respect to information on any sexual offenders registered under Article 27A of Chapter 14 of the North Carolina General Statutes (N.C.G.S. §§ 14-208.5-208.45) such information may be obtained by contacting the local Sheriff’s Department or by looking on the NC Dept of Justice website at http://www.ncdoj.gov/Protect-Yourself/Find-Sex-Offenders.aspx. For properties located in Georgia, applicant(s) should exercise whatever due diligence they deem necessary with respect to information on any sexual offenders registered in accordance with O.C.G.A. § 42-1-12. Such information may be obtained by contacting your local police department or the Georgia Bureau of Investigation at 404-244-2600, or by looking on the GBI website https://gbi.georgia.gov/georgia-sex-offender-registry. |

You agree by making a one-time or recurring payment, you authorize your financial institution to honor and Abbitt Management to initiate debit(s) or correction entries for such payments.
You agree by selecting the recurring payment method you authorize your financial institution to honor and Abbitt Management to initiate debit(s) or correction entries for such payments on the 1st day of each month. If the current month’s charges have already been posted at the time of recurring selection you will need to make a one-time payment for the current month and your recurring payment will begin the 1st day of the following month.
You guarantee that you have all necessary rights, power and authority to authorize each such payment and that you will take all necessary steps as your financial institution requires to make such authorization. You agree there are sufficient funds available in your bank account to meet each one-time or recurring online payment. If there are insufficient funds in your account, your financial institution and Abbitt Management may charge you a NSF fee, a late fee or any other fee in accordance with your lease agreement.
You agree you are solely responsible for paying any and all fees charged by your financial institution and Abbitt Management. It may take up to two business days for your financial institution to reflect payment.
We cannot accept liability for a payment not reaching the intended account on time due to incorrect banking account information being entered. Any overpayments resulting in a credit balance cannot be refunded but will be applied as a credit on your account.
Any rental payment received after legal action has been initiated by the Management will be accepted with reservation, and will be applied to delinquent rent due, but will not affect any legal action instituted by the Management against Tenant to recover delinquent rent and possession of the premises.
You agree your online account balance is subject to errors, omissions, changes, and may not fully encompass all transactions due to delays in postings. You agree to pay all charges due in accordance with your lease agreement and any such delay in posting in no way relinquish Abbitt Management’s right to collect said charges.
Abbitt Management has no responsibility for any failure or error in any online payment, including without limitation, any interruption, omission, mistake, malfunction or delay related thereto.
